If a citizen receives an AVVISO DI ACCERTAMENTO VIOLAZIONE, which is a penalty notice for traffic violation (a pink paper put on the windscreen of the vehicle), it is possible to pay it within 5 days from the date of the penalty, in the following manner:
· At any Post Office

The receipt must state:
- the name of the owner of the vehicle
- the number and date of the penalty notice
- the number plate of the vehicle
· At the city tabaccherie (tobacco shops) under agreement which display the brand name T-SERVE
If the payment is made within 5 days from the date of the penalty notice, it grants a reduction of 30% of the amount of the penalty (both the full and the reduced amounts are specified in the notice).
The payment made after 5 days from the date of the penalty notice is still considered valid (so the penalty is paid off) as long as it is made in full (though the right of the 30% reduction is lost) and before the report of the notice is sent to the vehicle owner’s address. If the offender doesn’t pay the penalty notice, within 90 days from the date of the notice the vehicle owner will receive a VERBALE DI ACCERTAMENTO VIOLAZIONE, which is a report of penalty notice for traffic violation with a cost increased by the notification fees and which needs to be paid within 90 days from the date of the notice in the same ways as the payment of the penalty notice.
Once again, the payment within 5 days from the date of the notice grants a reduction of 30% of the amount of the penalty. If the report of penalty notice is not paid within the period referred, the full amount doubled and increased by the fees, will be registered and the citizen will receive the related payment demand.
If a citizen receives a VERBALE DI CONTESTAZIONE IMMEDIATA, which is a report of immediate notification (the police officer hands it in directly on the street) for the violation of a standard rule of the Traffic Code, he/she can pay the penalty in the same ways as the payment of the penalty notice, within 60 days from the date of the notification (which counts as the notice). Once again, the payment within 5 days from the date of the notice grants a reduction of 30% of the amount of the penalty.
If the report of immediate notice is not paid within the period referred, the full amount doubled and increased by the fees, will be registered and the citizen will receive the related payment demand.
HOW LONG IS IT NECESSARY TO KEEP THE RECEIPT FOR PAYMENT?
The receipts must be kept for at least 5 years, as proof of the payment.
WHICH IS THE PROCESS FOR REGISTERING A COMPLAINT?
The Municipal Police can’t directly nullify the penalty notices and the reports of notification, unless there are data errors (wrong number plate, wrong road…): in this case, it is possible to request the withdrawal of the act in self-defence (all. 1).
It is not possible to appeal against the penalty notice, but only against a proper report of notification for violation (whether if directly on the street by the police officer or sent to the vehicle owner’s address). Therefore, if it is intended to file an appeal only holding the penalty notice, it is necessary not to pay it and wait instead for the report of penalty notice to be sent to the vehicle owner’s address. It is then possible to appeal against the report to the competent authorities as indicated below.
The appeal to nullify the report can be filed within 60 days from the notification before the Prefect or, alternatively, within 30 days before the Justice of the Peace.
The appeal before the Prefect (all. 2) must be forwarded to the Office or the Municipal Police Station who made the notification as follows: it can be lodged to the U.R.P. (Public Relations Office) of the District of Pisa (Lungarno Galilei, 43) or sent to the Municipal Police Station by registered post with acknowledgement of receipt or by PEC (Certified email). The Municipal Police Station will take care of sending the appeal to the Prefect.
The appeal before the Justice of the peace (all. 3) must be lodged directly to the Chancellor’s Office (via Palestro, 39).
The penalty notices and the reports of penalty notice made by the traffic policemen follow the same above-written procedure.
