Pisa 9 marzo 2010 – SULLA RIFORMA BRUNETTA
Le riforme della Pubblica amministrazione sono necessarie. Lo dicono le nostre performance, insufficienti nella comparazione con altre amministrazioni europee e rispetto ai bisogni di governo della nostra società. Lo dice anche il consenso che la campagna fatta dal ministro Brunetta ha registrato. Serve uno sforzo di governo enorme, sostenuto da regole innovative e da investimenti e va combattuta una battaglia culturale. Ci sono buone riforme ancora da attuare e buone pratiche che possono fare d’esempio, in un sistema di monitoraggio che veda il protagonismo delle autonomie locali. Servirebbe dunque distinguere e servirà a poco, c’è da temere, una facile campagna mediatica fondata sulla cultura della sfiducia. Non si faranno progressi se ai problemi veri saranno date risposte sbagliate.
Si era convinti che dopo l’approvazione del nuovo Titolo V della Costituzione la stagione del centralismo amministrativo fosse definitivamente conclusa. Si registra invece una produzione legislativa sempre più volta a limitare e a comprimere i diritti di autonomia statutaria, regolamentare e organizzativa che la Costituzione ha riconosciuto agli enti locali territoriali e alle regioni. E ciò mentre, lo dico solo all’inizio, ma si riflette su ogni problema affrontato, è aperta una evidentissima “questione democratica”, con un allentamento della statualità e un impoverimento della risposta pubblica. Viviamo dinamiche dissolutive dell’equilibrio fra i poteri – anche fra Governo-Parlamento e sistema delle autonomie –, gravissimi conflitti d’interessi, lesioni dei principii essenziali d’imparzialità dei poteri pubblici, che producono effetti regressivi sulle amministrazioni pubbliche, pratiche diffuse di corruzione secondo gli esempi che vengono dai rami più alti di una certa politica. Dinamiche che valgono assai più di una legge delega o di un decreto legislativo.
Anche il modo con cui il ministro Brunetta sta realizzando il suo progetto di modernizzazione della pubblica amministrazione è permeato di conflitti istituizionali evidentissimi e da derive centraliste che non possono essere condivise, e nei confronti delle quali si deve manifestare e far valere un dissenso, in modo molto più incisivo rispetto a quanto visto fino ad ora.
Il decreto legislativo n. 150/2009, infatti, intervenendo sul modo di lavorare dei dipendenti pubblici con l’obiettivo di accrescere l’efficacia dell’azione amministrativa e così modificarne sotto il profilo qualitativo il raccordo con i diritti dei cittadini, pone al mondo delle autonomie e dei poteri locali, al di là delle esternazioni che ne hanno accompagnato l’entrata in vigore, spettacolarizzandola, alcuni seri problemi: ordina mentali, finanziari, organizzativi e di sistema di valutazione.
Il primo problema chiama in causa una questione che per noi è fondamentale, perché afferisce direttamente al modello di organizzazione della Stato, e quindi investe i principi fondanti della nostra Carta Costituzionale.
Dalla nascita della Repubblica il sistema delle autonomie locali ha costantemente rivendicato l’attuazione del principio costituzionale che disegna un modello equiordinato di organizzazione dello Stato; modello che, però, ha dovuto attendere trent’anni per ricevere una prima parziale disciplina normativa, attraverso la legge n. 382 del 1975 fondata su principi in linea con il dettato costituzionale.
Dal 1975 a oggi si è sviluppato un confronto serrato tra lo Stato e i poteri locali, nel corso del quale lo Stato centrale ha cercato di conservare il proprio tradizionale ruolo di sovraordinazione (come dimostrato dai contenuti del deludente DPR n. 616 del 1977 e da una molteplicità di successivi atti normativi) mentre il sistema dei poteri locali ha continuato a rivendicare i propri diritti di autonomia ordinamentale, con il risultato di ottenere quindici anni dopo, nel 1990, la legge n. 142, seguita, nel 1995, dal decreto legislativo n. 77, nel 1997 dalle leggi Bassanini, nel 2000 dal T.U.E.L. e, svolta fondamentale, ottenendo, nel 2001, la modifica del Titolo V della Costituzione.
Per il sistema delle autonomie locali e regionali la revisione costituzionale del 2001 ha rappresentato e rappresenta il punto di partenza strategico per avviare la realizzazione di un nuovo modello di organizzazione della società e dello Stato, all’interno del quale collocare nuovi e più avanzati processi di riqualificazione della pubblica amministrazione fondati su principi di innovazione, di modernizzazione, di decentramento effettivo delle competenze, di trasparenza, su rapporti solidali e partecipati con i cittadini. Valgano, quale riconoscimento, i ripetuti richiami del Presidente Napolitano.
Il ministro Brunetta recepisce molti dei principi –innovazione, modernizzazione, trasparenza, rapporti di tipo nuovo con i cittadini –, ma li colloca all’esterno dell’equiordinamento e del decentramento delle competenze, affrontando e risolvendo i problemi inun’ottica neocentralista, che si auspicava fosse stata definitivamente superata dalla riscrittura del Titolo V e che invece riemerge in conflitti sempre più laceranti e sempre a spese delle autonomie locali.
Il decreto legislativo n. 150/2009 è infatti guidato da logiche di omologazione così incidenti da annullare, o quanto meno da comprimere fortemente, in materia di organizzazione delle attività di gestione delle amministrazioni pubbliche, i diritti di autonomia di cui sono titolari i comuni, le province e le regioni, esercitati in via regolamentare e con l’adozione di corrispondenti e autonome misure organizzative. Ciò avviene con la scelta della avocazione al centro dell’attività di controllo sulle modalità di espletamento degli atti di gestione.
L’attività di controllo che viene introdotta è così ampia da fare rimpiangere i vecchi, e mai abbastanza aborriti, controlli di merito. I controlli, infatti, non vengono esercitati sui risultati finali della gestione, ma su ogni fase del processo di espletamento di ogni singolo procedimento gestionale; non vengono esercitati sui costi finali di ogni servizio erogato, ma su tutte le fasi intermedie di produzione di costi; non vengono esercitati sulla governance delle decisioni pubbliche, ma sul modo con il quale si procede ad attuarle.
Il meccanismo prescelto per esercitare questa forma di controllo, globale e invasivo, è piuttosto diabolico, perché si fonda sull’instaurazione di un rapporto diretto tra l’amministrazione centrale dello Stato e i dirigenti degli enti locali e delle regioni, sostitutivo dell’attuale modalità regolatrice dei rapporti tra gli organi di governo dei poteri locali e la loro dirigenza. Come questa attività sostitutiva possa dare un contributo di modernizzazione al funzionamento delle amministrazioni pubbliche locali, è questione che il ministro non riesce spiegare.
Il ministro difende questo meccanismo, giustificandolo con esigenze di omogeneizzazione sul territorio nazionale del modo di lavorare delle amministrazioni pubbliche, oltre che con i vantaggi in materia di trasparenza e di integrità che ne conseguono in termini di rapporti tra lavoro pubblico e soddisfazione dei bisogni civili e sociali della collettività. Ma non tiene conto degli effetti prodotti, non solo sul territorio ma sui valori di rappresentanza e di autonomia che sono alla base di ogni democrazia.
L’esercizio della governance delle decisioni pubbliche degli enti locali è incardinato nel concetto “squadra del sindaco o del presidente della provincia”, composta dalla Giunta e dai dirigenti apicali. In merito il T.U.E.L. disegna un modello che sino ad oggi ha funzionato bene, dove è stato correttamente applicato, e che è profondamente ingiusto distorcere o inquinare con iniezioni di centralismo.
Dunque a mio avviso vanno rivisti in profondità i poteri assegnati dall’articolo 13 del decreto legislativo n. 150/2009 alla Commissione nazionale istituita per la misurazione e valutazione delle performance organizzative delle amministrazioni pubbliche, quanto meno per ciò attiene agli enti di governo regionale e locale e alle loro appendici strumentali. E serve collocare l’Organismo indipendente di valutazione all’interno dei sistemi di controllo degli enti locali, eventualmente prevedendo una obbligatoria attività di referto dell’Organismo alla Commissione centrale (pur essendo consapevoli che tale attività di referto costituirebbe un duplicato rispetto a quello già oggi reso dagli enti locali territoriali alla Corte dei conti e al Ministero dell’interno).
Il secondo problema chiama in causa i costi, questione alla quale la presente stagione politica è molto sensibile e alla quale gli enti locali annettono molta importanza, stante l’obbligo di salvaguardare comunque gli equilibri finanziari della gestione.
Il decreto legislativo n. 150/2009 prevede, con stile tremontiano, che tutti gli adempimenti previsti dai suoi contenuti debbano essere compiuti senza spese aggiuntive, pur essendo evidente che ogni adempimento di natura strutturale ha un costo “una tantum” aggiuntivo e che ogni adempimento di natura gestionale ha un costo aggiuntivo ricorrente e continuativo. Il decreto dispone che tali costi aggiuntivi debbano trovare copertura attraverso una rideterminazione, e conseguente contrazione, dei costi dei servizi attualmente erogati e dei compiti amministrativi attualmente svolti.
Il governo però non può ignorare che tale rideterminazione è stata già compiuta dagli enti locali per ottemperare alle regole introdotte attraverso il patto di stabilità. E che i comuni e le province hanno già raschiato il barile delle risorse finanziarie di cui avvalersi, barile reso ancora più vuoto dopo la drastica contrazione del gettito ICI e i tagli apportati ai trasferimenti erariali (che in cinque anni hanno accresciuto l’incidenza nella composizione delle entrate dal 40 al 60 per cento). E ciò con una crescita della spesa centrale e ministeriale, a partire da quella per la Presidenza del Consiglio dei Ministri, fino alle autority di nuova istituzione. Per non dire degli interventi premiali, sempre più numerosi, per le amministrazioni locali amiche: Catania docet.
Esistono dunque fondate ragioni per ritenere che gran parte degli enti locali non saranno in condizione di sostenere i costi strutturali e gestionali richiesti dal decreto. E poiché il rischio di non poter ottemperare, per ragioni oggettive e facilmente documentabili, è molto forte, abbiamo chiesto al ministro di proporre l’adozione di un provvedimento urgente di finanziamento dei costi aggiuntivi. Quantomeno per l’anno 2010, per avere il tempo di capire “sul campo” l’entità dei costi aggiuntivi, il livello della loro rigidità temporale e le economie che concretamente possono essere realizzate.
Il terzo problema chiama in causa i dipendenti e le modalità strutturali del nuovo sistema premiale e di valutazione. A questo proposito, non è in discussione il principio del riconoscimento e della valorizzazione del merito, assunto come criterio direttore della valutazione della prestazione lavorativa del pubblico dipendente. Così come non è in discussione il principio che coniuga responsabilità, nel dirigere l’espletamento di un programma o di un atto di gestione, e valutazione degli apporti dati da ogni dipendente per il conseguimento degli obiettivi gestionali intermedi e finali.
Già da anni, dalle leggi Bassanini in poi, con l’ausilio di una corposa normativa di carattere generale, si è provveduto a dare attuazione al principio di separatezza tra amministrazione e gestione, con il riconoscimento di una competenza esclusiva dei dirigenti. Si tratta di riforme ancora oggi validissime, per le quali lo stesso Bassanini ha tracciato recentemente un percorso da riprendere, affrontando i punti critici emersi dall’esperienza.
Il T.U.E.L. recepisce la materia in modo organico ed esaustivo, anche attraverso l’introduzione, al vertice della struttura dell’ente locale, di una figura professionale esclusivamente manageriale, il direttore generale, al quale affida il compito di organizzare l’intero lavoro della struttura, coinvolgendo in tale processo la dirigenza, con criteri di managerialità pubblica e nella consapevolezza della differenza fisiologica che deve distinguere quest’ultima da quella privata.
Il decreto legislativo n. 150/2009 interviene in modo rozzo su tale meccanismo, modificandolo in profondità: toglie al direttore generale il potere di valutare l’operato dei dirigenti, anzi un’altra recente misura normativa prevede proprio l’abolizione della figura professionale del direttore generale, almeno per la larghissima parte dei comuni; attenua i rapporti tra la dirigenza e gli organi di indirizzo politico-amministrativo, affidando la valutazione dei dirigenti a un organo interno-esterno, l’Organismo indipendente, collocato in posizione sotto-ordinata rispetto alla Commissione nazionale, dalla quale riceve direttive cogenti sul come operare; trasforma il Sindaco e la Giunta in soggetti dal profilo notarile, tenuti a recepire e ad attuare quanto in materia stabilito dall’Organismo indipendente e dalla Commissione nazionale.
Questo modo di procedere non può essere accettato, perché è lesivo dell’autonomia organizzativa che la Costituzione riconosce agli enti locali territoriali.
Il decreto, peraltro, interviene “a gamba tesa” anche nella disciplina dei premi al merito, introducendo l’obbligo alla valutazione differenziata delle prestazioni lavorative dei dipendenti. Anche questo meccanismo appare rozzo e contraddittorio. Non si può, infatti, impostare una norma sulla riqualificazione del lavoro pubblico e nello stesso tempo circoscrivere quantitativamente l’attività di riqualificazione.
Il ministro Brunetta dà per scontato che in ogni reparto organizzativo delle strutture debbano essere presenti dei dipendenti incapaci da punire, dei dipendenti fannulloni da sanzionare, dei dipendenti da indicare come pesi morti dell’attività gestionale.
Il ministro evidentemente non pensa che in un ente locale possa esistere un reparto organizzativo all’interno del quale tutti i dipendenti siano bravi, in possesso di elevati livelli di professionalità e consapevoli dei propri doveri nei confronti dell’amministrazione pubblica e dei cittadini utenti. E non pensa all’effetto che il sapere che, in ogni caso, almeno il venticinque per cento di loro dovrà ricevere alla fine di ogni anno un pubblico marchio di demerito professionale potrà determinare sui dipendenti di quel reparto organizzativo durante l’espletamento delle fasi di gestione della performance organizzativa.
A mio avviso si è in presenza di una miopia grave che il Governo ha il dovere di correggere senza indugi. Se un dipendente merita, il merito deve essere comunque riconosciuto a prescindere da normative fondate su quote che danneggiano l’espletamento dell’azione amministrativa.
Il meccanismo della suddivisione per legge del merito e del demerito in quote percentuali predeterminate è piuttosto ignobile, a mio avviso, perché è una sentenza scritta prima che il processo venga avviato; perciò va rimosso, introducendo al suo posto disposizioni più rigorose e stringenti di controllo interno sulla valutazione delle performance organizzative individuali.
Ogni anno, va ricordato a Brunetta, in sede di Forum della PA, viene data visibilità alle “buone prassi” attuate dagli enti locali; e ogni buona prassi coinvolge l’impegno di tutti i componenti di un reparto organizzativo. E anche che in sede di esercizio del proprio ruolo manageriale, tra l’altro oggetto di valutazione, ogni dirigente è sempre tenuto ad adottare tutte le misure utili per elevare il livello delle performance lavorative dei propri dipendenti. Fattori, questi, che il decreto legislativo n. 150/2009 ignora, o finge di ignorare, e che invece si avrebbe il dovere di stimolare attraverso disposizioni conseguenti e condivise.
La via della qualificazione del lavoro delle amministrazioni pubbliche, del loro miglioramento e della loro modernizzazione, è certamente difficile, e richiede interventi innovativi e coraggiosi.
L’innovazione e il coraggio di promuoverla non devono costituire alibi per introdurre forme di criminalizzazione preventiva, per campagne mediatiche e senza vere riforme.
I dipendenti degli enti locali non sono tutti fannulloni o incapaci, così come i giovani non sono tutti “bamboccioni” o “mammoni”. E di certo gli amministratori locali per non essere trattati da “bamboccioni” devono ritrovare la dignità e la forza per parlare con chiarezza ai cittadini, al Governo e al Parlamento. Per vincere la regressione che il paese sta vivendo, anche in questa dimensione nevralgica. Questo anche perché la riforma Brunetta sia modificata in quelle parti in cui essa necessita di essere corretta in profondità.
