5 Agosto 2010 – Federalismo municipale, Filippeschi: siamo delusi e preoccupati
Ieri, mercoledì 4 agosto, il Consiglio dei Ministri ha approvato su proposta dei Ministri Tremonti, Bossi, Calderoli, Fitto e Ronchi, un nuovo schema di decreto legislativo attuativo della riforma del federalismo fiscale, entrando nel vivo della devoluzione fiscale ai Comuni. In una nota di Palazzo Chiggi si legge: “Nella fase di avvio (di durata triennale) i Comuni riceveranno il gettito dei tributi immobiliari, che manterranno fino ad allora l’assetto attuale; dal 2014, invece, saranno introdotte nell’ordinamento fiscale due nuove forme di tributi propri: un’imposta municipale propria e un’imposta municipale secondaria facoltativa.
Delusione e preoccupazione per i contenuti del provvedimento vengono espresse da Legautonomie, che a voce del suo Presidente, il Sindaco di Pisa On. Marco Filippeschi, dichiara : ”I tagli sono certi, le nuove entrate no. Siamo delusi e preoccupati. Tirando le somme cosa porteranno in cassa i comuni? Questa è la domanda che i sindaci si fanno. Siamo in vista della elaborazione dei bilanci, con scelte che si annunciano drammatiche, e non vengono certezze nuove. Quello che gli enti locali invece chiedevano”.
I punti chiave del provvedimento votato dal CdM sono così riassunti dal comunicato stampa ufficiale del governo:
- è devoluto ai Comuni, relativamente agli immobili ubicati nel loro territorio, il gettito derivante da alcune imposte tra cui l’imposta di registro, ipotecaria e catastale, l’IRPEF relativa ai redditi fondiari (escluso il reddito agrario), l’imposta di registro e di bollo sui contratti di locazione relativi ad immobili, i tributi speciali catastali, le tasse ipotecarie, la nuova cedolare secca sugli affitti. Vengono stabilite misure finalizzate a rafforzare la capacità di gestione delle entrate comunali e ad incentivare la partecipazione dei Comuni all’attività di accertamento tributario;
- è istituita l’imposta cosiddetta cedolare secca sugli affitti, rilevante novità dello schema di decreto legislativo, un regime fiscale che il proprietario di immobili locati avrà facoltà di scegliere in alternativa a quello attuale. A decorrere dall’anno 2011 il canone di locazione relativo ai contratti stipulati per immobili ad uso abitativo, e relative pertinenze affittate congiuntamente all’abitazione, potrà essere assoggettato, se il locatore così deciderà, a questa nuova imposta sostitutiva dell’IRPEF e delle relative addizionali, nonché dell’imposta di registro e dell’imposta di bollo sul contratto di locazione. La cedolare secca potrà essere applicata anche ai contratti di locazione per i quali non sussiste l’obbligo di registrazione;
- nella seconda fase dell’attuazione del federalismo fiscale municipale, a partire dal 2014, per il finanziamento dei Comuni ed in sostituzione delle attuali, saranno introdotte nell’ordinamento fiscale due nuove forme di tributi propri: un’imposta municipale propria ed un’imposta municipale secondaria facoltativa. La prima sostituirà, per la componente immobiliare, l’imposta sul reddito delle persone fisiche e le relative addizionali per i redditi fondiari relativi ai beni non locati, l’imposta di registro, l’imposta ipotecaria, l’imposta catastale, l’imposta di bollo, l’imposta sulle successioni e donazioni, le tasse ipotecarie, i tributi speciali catastali e l’imposta comunale sugli immobili; essa non si applicherà al possesso dell’abitazione principale;
- l’imposta municipale secondaria facoltativa, invece, potrà essere introdotta, anch’essa dall’anno 2014 e con esclusione degli immobili ad uso abitativo, per sostituire una o più delle seguenti forme di prelievo: la tassa per l’occupazione di spazi ed aree pubbliche, il canone di occupazione di spazi ed aree pubbliche, l’imposta comunale sulla pubblicità e i diritti sulle pubbliche affissioni, il canone per l’autorizzazione all’installazione dei mezzi pubblicitari, l’addizionale per l’integrazione dei bilanci degli enti comunali di assistenza.
Cosi Filippeschi entra nel merito dei provvedimenti:
“Cosa verrà ai comuni in risorse aggiuntive da mettere in bilancio dalla cedolare secca sugli affitti e qual è la base imponibile – domanda Filippeschi -? Perché la Imu vale a partire da 2014 e come si pensa che i comuni possano arrivare fin lì, visto il taglio diretto di un miliardo e duecento milioni e quelli riflessi dai tagli alle regioni?
Qual è il quadro complessivo delle scelte sul federalismo demaniale, con il consolidamento delle scelte di trasferimento, e che effetti può avere sulle finanze comunali, almeno come stima?”.
“A queste tre domande oggi non si è risposto – aggiunge Filippeschi – chiediamo risposte. E non si può chiedere ai comuni un suicida affidamento a prospettive indefinite. Si conferma quanto Legautonomie ha sostenuto nelle settimane scorse: resta aperta una questione irrisolta col governo e restano necessarie una mobilitazione molto forte e misure esplicite e significative da parte dei comuni che dimostrino resistenza nel conflitto istituzionale irrisolto. Perché i cittadini e le imprese capiscano che cosa sta accadendo, prima d’essere inevitabilmente colpiti”.
